Welcome to the website of Affiliates in Plastic Surgery, LLC (“the Practice,” “we,” “us,” or “our”), a Commonwealth of Virginia limited liability company. We’ve created these Terms and Conditions of Use (what we’ll call “Terms”) to help clarify the rules that govern your access to and use of the website located at https://www.affiliatesinplasticsurgery.com/ (the “Site”), including any content, features, functionality, and services offered on or through the Site, and certain rules that govern your interaction with us.

These Terms form a legal contract between you and the Practice. By accessing or using the Site, you agree to the Terms and to be bound by these Terms. If you do not agree to these Terms please do not use the Site.

If you choose to access or use the Site, please read these Terms carefully, they contain important information about your legal obligations and your rights.

1. Scope of Terms.  These Terms constitute a legally binding agreement between you and Affiliates in Plastic Surgery, LLC. By accessing the Site, you represent that you are at least 18 years of age or have the legal capacity to enter into these Terms, and you warrant that you can form a binding contract with the Practice. If you are under 18, you may only use the Site with the consent of a parent or guardian.

Purpose of the Site.  The Site is intended to provide general information about Affiliates in Plastic Surgery, LLC, including the scope and nature of the various services offered by the Practice, along with certain resources for patients and prospective patients of the Practice. The Site is not intended to offer medical advice, diagnose medical conditions, or provide treatment recommendations in any manner whatsoever.

3. Medical Disclaimers.

No Medical Advice: The content on the Site is for informational purposes only and should not be construed as medical advice. Always consult a qualified healthcare provider for medical advice or treatment.

Emergencies: The Site is not designed to address medical emergencies and is only meant to provide information on the services generally provided by the Practice. In case of an emergency, call 911 or contact local emergency services.

4. Intellectual Property.  All content, design, graphics, trademarks, logos, icons, user interface elements, designs, photographs, and any copyrightable material the Practice makes available on the Site (all “Intellectual Property”) and other materials on the Site are the property of Affiliates in Plastic Surgery, LLC, or its licensors, and are protected by intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from the Site content without prior written permission from us.

5. Acceptable Use.  When using the Site, you agree to use the Site only for lawful purposes and in accordance with these Terms. You also agree to only provide accurate and truthful information when submitting forms or inquiries.

We reserve the right to terminate your access to the Site for violations of this section.

User Submissions and Communications.  If you submit information through the Site, such as through contact forms or comment fields, you agree that all information provided is accurate and does not infringe on the rights of others, and by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, or distribute your submissions for purposes consistent with our business—we have no intention of reselling any such information, but we may retain copies as part of our general records to ensure proper patient recordkeeping. We reserve the right to remove any user-submitted content that violates these Terms or applicable laws. These links are provided for your convenience and do not imply endorsement by us. We are not responsible for the content, privacy practices, or functionality of third-party sites. Your use of third-party services is at your own risk and subject to their terms of use. To the extent available, we will endeavor to provide any applicable third-party terms of service on your reasonable request.

Indemnification.  You agree to indemnify and hold harmless Affiliates in Plastic Surgery, LLC, and its principals, owners, members, affiliates, subsidiaries, employees, and agents from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising from your use of the Site or violation of these Terms, whether through negligence, willful acts, or otherwise.

11. Modifications to Terms.  We may revise these Terms from time to time and at any time by updating this page. We will endeavor to reflect the date of such modifications at the top of this page. Your continued use of the Site after any modifications constitutes your acceptance of the updated Terms.

12. Termination.  We reserve the right to terminate or suspend your access to the Site without prior notice for any violation of these Terms or any other reason in our sole and absolute discretion.

13. Governing Law.  These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to any choice or conflict of law principles.  With respect to any disputes or claims related to or arising from these Terms, you agree not to commence or prosecute any action in connection therewith other than in the state and federal courts in Virginia, and you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the state and federal courts in Virginia.

14. Severability.  If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision to the extent permitted by the court and relevant laws, and that the other provisions of the Terms shall remain in full force and effect regardless of the potentially invalid provision.

15. Definitions, Constructions, Headings.  Unless otherwise specified, the terms "includes", "including", "e.g.,", "for example", and other similar terms are deemed to include the term "without limitation" immediately thereafter. Terms used in these Terms with the initial letter(s) capitalized will have the meaning attributed to them in these Terms.  The Section headings contained in these Terms are for reference purposes only and do not in any way affect the meaning or interpretation of any Section of these Terms.

16. Notices.  Our notice to you via email, regular mail, or notices or links displayed in connection with the Terms constitutes acceptable notice to you under the Terms. We are not responsible for your failure to receive notice if email is quarantined by your email security system (e.g., “junk” or “spam” folder). Notice will be considered received forty-eight hours after it is sent if transmitted via email or regular mail. In the event that notice is provided via links displayed in connection with the Terms, then it will be considered received twenty-four hours after it is first displayed.

17. Waiver.  The failure of the Practice to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision in that or any other instance.

18. Entire Agreement.  These Terms constitute the entire agreement between you and the Practice regarding the use of the Site, superseding any prior agreements between you and the Practice relating to your use of the Site. This Agreement may not be changed orally.
